Bloomingburg’s board of trustees will revisit an agreement between the village and the developer of Emerald Living Estates LLC, formerly known as Chestnut Ridge, who is seeking permits to raise the number of units to be built to 520 from the 396 previously approved.

The larger development is now before the zoning board of appeals, which doubles as the planning board.

The new plan was submitted by the BerkCo Group, a real estate investment group including Israel C. Berkowitz. The group already received approval to subdivide what had been 94 acres of common areas inadvertently assigned to the Chestnut Ridge homeowners association because of a mistake in the original deed.

After the split, the homeowners association has ownership of 14 acres directly around the 107 townhouses that have been built. The remaining 80 acres were conveyed to Emerald.

The corrected deed was the first step in converting future development at Chestnut Ridge to condominiums from townhouses. A public hearing on the second part of the conversion plan will be continued on Nov. 22 before the ZBA.

The original Chestnut Ridge site plan included 396 individual lots, each destined for a townhouse. The new one would consolidate the lots yet to be developed into a single parcel. The parcel would then be resubdivided into lots for condominiums. All the new units would be built on the south side of Winterton Road, Mayor Russell Wood Jr. said at Monday night’s board meeting.

When the common areas subdivision was approved, Emerald’s attorney, John W. Furst, said the number of units would remain at 396. Trustee Chaim Friedman said the plan under consideration does envision 520 units, containing the same total number of bedrooms originally included in the larger townhouses.

The state Department of Conservation, the Board of Health and village must all sign off on the revised development Wood, said.

The mayor said the village’s agreement with the developer includes such items as who will own the roads in the development. Under the original agreement, the roads were private. The new proposal envisions the village owning the roads.

The original site plan approval also required the developer to build a sidewalk along busy Winterton Road. For various reasons, the sidewalk was never built. Since then, the village, the town of Mamakating and Sullivan County came to an inter-municipal agreement clearing the way for the sidewalk construction. Friedman said Tuesday in a phone conversation that the start of construction is inching forward.

The trustees scheduled a public hearing on the developer-village agreement for Dec. 11.

Repaving, job opening, violations

Wood said grinding and resurfacing of a stretch of Winterton Road is scheduled to start when the weather breaks in the spring. The job was delayed in part because the village was short of cash because of the change in the village’s fiscal year, which delayed tax collection.

The mayor said the village is looking to hire a full-time DPW worker. The current part-timer can’t devote any more time to the village because he has other commitments, Wood said.

The new hire must be a jack-of-all-trades, the mayor said. For example, the worker will also be responsible for routine maintenance at the sewer plant.

Village attorney Alex Smith said he has filed a number of code violations with Village Court Judge Julia Sherman. Some of the violations relate to Winterton Condominiums, which was approved for 28 units, but built 42. Smith said it’s unlikely the cases will come up this month.
